What Is H-1B Premium Processing?

Premium Processing (PP) is an optional service that guarantees USCIS will adjudicate an H-1B petition within 15 business days of receiving the premium processing request. If USCIS fails to meet this deadline, it refunds the fee and continues adjudication at no extra charge.

What "15 Business Days" Really Means

The clock starts when USCIS receives the Form I-907 (premium processing request) and fee, not when the underlying I-129 is filed. Within 15 business days, USCIS must issue one of:

  • An approval notice (I-797A)
  • A Request for Evidence (RFE)
  • A Notice of Intent to Deny (NOID)
  • A denial

Note: An RFE restarts the 15-day clock after USCIS receives the response.
